Marriage : Vanish The Women’s Right
Commonly in Indonesia there is one way to link the legal relationship
between men and woman. The legal relationship is linked by marriage. Law of
marriage in Indonesia has been ruled by
goverment. There are many rules which regulate on marriage. Mostly culture in
Indonesia is marriage which the wedding is recognized by government escpecially
KUA. People who wants to marry must be registrated on department of religion (KUA).
After that, they get married undoubtedly recorded by government . So their
marriage is legal, the rights and obligations
of marriage are applied. Nowdays, culture of legal marriage in Indonesia has been moved into
underhand marriage. This phenomenon creates a contradiction in public. The topic
of underhand marriage gives many positive and negative opinion. So, what
actually happened from this way? Is the way benefical or even cause new public
problems?
As the public know that underhand marriage is the way to
marry without a legal recorded. The other words is marriage without
registration from department (KUA) so the marriage of couple have no legally record
on goverment. And then, underhand marriage is the way to marriage where there
is no presence of family from the women
(as known as wali nikah). So wali nikah is
represented by another person. Usually it has been held by the couple who
they want to conceal their marriage
because of certain reason. Actually, underhand marriage is legal based on
Islamic’s law. The law regulates to hold marriage must be have one wali nikah. But he or she is from
women’s family. In fact, mostly of presence on marriage is from another stranger
people. So, can we called it legally?
Talk about underhand marriage, we can get easy reason
that through of this, the marriage feel simple and we don’t need much
financial. Prove that underhand marriage just need little bit fund. After
married, we do not need the wedding party.
Another mind view is to avoid
cohabitation. Through underhand marriage, people can avoid from free sex, HIV,
and AIDS as way as they do not change another mate many times. Moreover,
underhand marriage can curbs the gossip from public. They hope that public can
accept their new status.
Based
on culture of Indonesia, underhand marriage also called by illegal marriage.
Their marriage consequently have no legally records on department of religion
(KUA). So, if there is any problem home or one of them get disadvantages, the
law of marriage can’t be applied. Come
from now, it shows that underhand marriage will be create new public problems. The
approach problems are reasonable thing to have affair. Also there will be many
polygamous, absence of clarify status of wife and children in the law of
Indonesia, and sexual harassment against womankind. The word that we must be
underlined is there is no legally status for the wife and children. The
marriage makes the wife or women have no rights to complain if they get bad
treatment from their husband. The wife
can’t prosecute their right if they get abuse from their husband. When they
will sue their problem into law institutions, they don’t get the real right and
the worst is the have no right to sue their problem because their marriage is
illegal so the law can’t help them. This is the worst disadvantages of
underhand marriage that is makes vanish the womens right in front of the law.
Living and growing as Indonesian society , underhand marriage will gives
disadvatages for woman because it is not the culture of Indonesia and the wife
can’t get their really rights. So it would be better to get legal marriage by
wedlock.
